What to do if an allegation is made against you
It is critical that you get legal representation at the outset. The laws to which police conduct investigations are significantly different form England.
In Scotland, a suspect is afforded the right to silence. The only information you require to give at a police station is your name, date of birth, address and nationality. You are not obliged to say anything at all beyond that, nor do you require to answer the allegations. A judge or a jury are not entitled to draw any adverse inference to a failure to answer any questions, it is important that you understand this.
This early stage is critical because people often think they can argue their way out of a case by telling the truth. Whilst it would be a wonderful works if that were true, our experience demonstrates that the system does not deal with the truth so much as investigate allegations of crime and increasingly take such allegations as credible despite contradictory evidence.
